After reading the article Jaron Lanier posted in the Wall Street Journal I now have a better understanding of where he’s coming from. As someone who considers himself as a writer/artist, I feel like I’ve worked hard on many projects only to turn around and give them away for free. Another portion of the article that was interesting was the fact that now anyone can edit something that someone post on the internet. I find this fact to be kind of scary. If someone puts their thoughts on a certain topic online it should stay as it is with no interference. It completley discredits the individuality of the thoughts and opinions of another. Instead of editing the content of another person wouldn’t it be a better idea to just leave a comment underneath their statement? Another good point that Lanier makes in his article is that it is highly possible for robotic technology to fill the occupations that human beings once or now hold/held. There is a great youtube video illustrating this exact point. David Simon is the writer/director of the HBO show The Wire. In this video link he discusses this uncertain future in further detail. http://online.wsj.com/article/SB10001424052748703481004574646402192953052.html. It’s really difficult to tell at this point whether or not we as a culture will be able to realize the frightening path in which we are headed. As has been the instance in many other situations, we as a culture tend to wait until things get as bad as they possibly can before any action is taken. I consider myself an optimist about this situation of human replacement. I feel deep down inside we all know what the future holds. At this point in time many of us have adapted to our web based lifestyles. But just as things get really bad I see our culture swinging in the exact opposite direction. Lets face it, alot of people are out of work right now. Thats alot of people who are ready to be productive. It’s ultimately up to all of us to educate eachother and move back in a positive direction for humanity. The answer is in our hands. The real question is whether or not we’ll see this before it’s too late.

Jaron Lanier Sparks Interview.

After listening to the Sparks interview that was done with author Jaron Lanier I have mixed feelings. I feel Lanier brings up some very fascinating points. Some of the points he makes such as people losing their sense of individuality is something I’ve discussed with friends. It is especially disturbing if you observe the effects the web 2.0 has on young adults. My younger brother is currently on Facebook. It appears to me that young adults around his age are so entrenched with the web that they have no self-awareness. This is specifically true of some of the comments that are made or photos that are posted. As we discussed a few weeks ago in class, once something is posted on the web its stays there. This is why I am highly cautious as to what I post. I agree with the point that the host makes at the end when she says that once something becomes a part of our daily lives we don’t think about it. I’ve been saying for quite some time now that we should all take a step back and think about where our relatively new technologies are changing us as a species. I disagree with Lanier when he says that the connectedness of the web is a bad thing. Thanks to this new era of human interaction it is possible to reach out to people instantly. These are people who, without web 2.0 technology we would have never known existed. All in all this was a very fascinating interview. I enjoyed it very much.

Fair Use Assignment

The first principle of the Fair Use doctrine deals with purpose and character. It protects the original creator of content in terms of not letting anyone copy their work(s) for their own personal profit. It is preferred that any parody of copyrighted content must be interpreted as transformative opposed to derivative. A somewhat recent example of this principle in action is illustrated in Supreme Court case Campbell v. Acuff-Rose Music. This case was centered around the rap group 2 Live Crew parody of the Roy Orbison song Pretty Woman.

The Second principle of the Fair Use doctrine deals with the nature in which a work is copied. It is much easier it seems to use content of a certain point in history or anything factual as opposed to using music, movies or etc. This is an advantage because it allows the content maker to express an ideas manifestation as opposed to the principles of a particular idea.

The Third principle of the Fair Use doctrine deals with the amount of copy written content that can be used in order for a work to be protected under the Fair Use doctrine. For example, one would have an easier time posting small amounts of selected work as opposed to large amounts of that same work. The Podcast gives the example of The Nation magazine taking a 400 word section from Gerald Fords autobiography. This was deemed as being too much sampling of a piece under copyright laws. The content sampled was considered at that time to be the heart of the book.

The Fourth principle of the Fair Use doctrine deals with whether the original piece of copy written work would have any market damage. For example, will more people buy 2 Live Crews version of Pretty Woman that Roy Orbison’s version. The Podcast detailed how the first principle often works in tandem with the fourth principle. If the content is seen as derivative it can affect the market of the original product. If it is seen as transformative it is creative take on a previously copy written work. For example, the Grateful Dead coffee table book was considered transformative making it legal. It was a creative piece that just so happened to contain copywritten material.

1. What rights and protections does copyright give the creator of a work?

-The creator of a work is given ownership of the fruits of their labor. This includes being able to authorize others in use of any intellectual property. The rights and protections of the creator include: the right to reproduce work, the right to distribute copies of the work to the public via sale or transfer of ownership, or via rental, lease or lending, the right to perform work publicly, the right to display work publicly, the right to create work closely related to an original work. This could include the translation of a book from one language to another or making a movie adaptation into a movie.

2. Why were rules about Fair Use established?

Rules about Fair Use were established to ensure that people would have access to information that they need to fully participate as citizens. This means users are allowed to use copyrighted works without permission or payment as long as the usage of the content has a benefit to society that outweighs the copyright holder. This holds true when used for purposes such as criticism, comment, news reporting, teaching, scholarship or research. The purposes mentioned above are all exempt from infringement.

3. What do you think this phrase means? “the production of new knowledge and cultural experience — are important for society”

-I think the phrase means it is not only important for society to grasp new knowledge to advance personally but it is also important as a culture that we advance. With new technology evolving as quickly as it does it is essential that everyone is up to speed on any new knowledge as it pertains to our cultural experience. Any new content produced is the publics right to observe and also to criticize freely if one chooses to do so.
